With a robust background in civil engineering and leadership in major infrastructure projects, I bring a wealth of expertise to the table as an expert witness.  My significant experience includes testifying in complex cases involving permit lawsuits, construction claims, utility disputes, and zoning and land use issues.  Notably, my work as the Executive Director fo the Metro Flood Diversion Authority in Fargo, ND has endowed me with unparalleled insights into large-scale project management and legal intricacies.  I have successfully navigated the legal challenges of  dealing with over 3,300 permit conditions, and managing contractual disputes, providing credible, detailed testimony that supports case resolution with precision and authority.

As a leading expert in eminent domain, I bring extensive experience from managing the acquisition of over 1,100 parcels, involving 70,000 acres of fee taking and property rights, essential for the successful execution of the $900 million land budget for the 3.2 billion Metro Flood Diversion Project.  Despite the project's vast scale, only 10% of these acquisitions required eminent domain proceedings, thanks to effective negotiation and management strategies.  My expertise also extends to delivering expert testimony in numerous court cases, demonstrating a deep understanding of the Uniform Relocation Act and other regulatory frameworks.  Additionally, I have pioneered innovative mitigation programs, such as the Farmstead Relocation Program, which have set new standards in the field and provided significant benefits to affected communities.

With extensive expertise in resolving complex disputes across a multitude of infrastructure projects, I offer unparalleled dispute resolution services.  My tenure as Executive Director of the Metro Flood Diversion Authority highlights my capacity to manage and resolve high-stakes conflicts effectively.  I successfully brokered a landmark settlement with a major opposition group, which not only resolved a federal case but also settled a contested Minnesota state construction permit case.  This agreement introduced innovative mitigation programs and was crucial in allowing the FM Diversion project to proceed on schedule and within budget.  Additionally, I have established and managed multiple dispute resolution boards that dealt with a range of issues from mitigation to construction and financial disputes, ensuring equitable solutions that uphold project integrity and stakeholder interests.

With deep-seated expertise in civil engineering design, I offer comprehensive design solutions across a spectrum of infrastructure projects, including highways, subdivisions, water systems, sewer and storm sewer systems, and flood control.  My work is exemplified by the meticulous review of over 650 plan sets during the FM Diversion project, ensuring each met the highest standards of quality and efficiency.  Additionally, my role in developing the comprehensive flood control plan for Miles City Montana, showcases my ability to design robust and effective flood mitigation strategies that address complex hydrological challenges.  My design approach combines technical precision with practical experience, aiming to deliver sustainable and resilient infrastructure solutions tailored to the specific needs of the community and environment.

I specialize in leading complex, large-scale infrastructure programs, exemplified by my leadership of the nation's first Split Delivery P3 USACE program for the Metro Flood Diversion Authority.  In this pioneering role, i employed cutting-edge project and program management techniques to keep this monumental $3.2 billion project both on schedule and within budget.  My extensive experience also encompasses the creation of numerous capital improvement plans, integrating advanced asset management practices to deliver infrastructure programs efficiently and cost-effectively for various clients.  My strategic approach ensures optimal resource allocation, risk management, and adherence to timelines, securing the best outcomes for all stakeholders involved.

My grant writing expertise is highlighted by my successful efforts to secure substantial funding for pivotal infrastructure projects, including $870 million from the North Dakota State Legislature and $750 Million from the Federal government for USACE construction on the Diversion project.  My experience extends to acquiring numerous funding allocations through FEMA, State Publie Facilities Authority programs, and U.S. Rural Development grants.  Notably, I was selected as a reviwer by FEMA for the 2022-2023 BRIC grant awards and have testified in front of the Senate EPW committee advocating for the continued use of P3 authority and funding for large flood control projects across the nation.  My involvement in securing the lowest intrest EPA WIFIA loan in history - $563 million at 2.01% for 40 years - underscores my capability to navigate complex funding landscapes.  I excel at lobbying for infrastructure projects, working tirelessly to secure the necessary resources for my client's critical projects.
